Among the various poll promises BJP made the two promises that caught the eye of residents of J&K were;
1. Rehabilitation of Kashmiri Hindus.
2. Abolishing Article 370.
Though the rehabilitation of Kashmiri Hindus is a distant reality because of lack of political will and lack of trust among Kashmiri Hindus towards the Government and Judiciary of this country. But the Article 35A may go soon.
Article 370 was a Constitutional blunder by Pt Nehru and Congress. Article 370 gives special rights to the people of J&K as it gives them the status of permanent residents. But on the other hand it bars Indians from the other states to buy land in J&K. Many Indian’s believe that this Article is a obstacle between the J&K and India and needs to go to properly integrate J&K with the nation.
Article 370 also don’t let J&K women remain the permanent resident of J&K if they marry outside the State. But that’s about to change because a women named Charu Wali Khan, recently filed a petition seeking changes in the constitutional provision as she wanted succession rights though she is settled outside the state.
Responding to her plea, the Supreme Court sent notices to the Centre and state last month. The woman has argued that the state’s laws, flowing from Article 35A, have disenfranchised her. Advocate General K Venugopal told the bench of Chief Justice J S Khehar and Justice D Y Chandrachud that the petition against Article 35A raised “very sensitive” questions that required a “larger debate”.
The court showed seriousness this time and referred the matter to a three-judge bench and has set a six-week deadline for final disposal. The bench is likely to deliver its verdict in September first week.
Many BJP ministers have spoke their mind on this issue, Union minister Jitendra Singh said that since the matter was sub judice, one should wait for the court’s verdict. He said the court verdict would be binding on all.
While the only Kashmiri Hindu Face in J&K assembly MLC Surinder Ambardar said “Article 35A is a constitutional mistake. It was incorporated through a presidential order and not through the parliamentary process,”
On the foundation day of PDP it’s chief and Chief Minister of J&K ‘Mehbooba Mufti’ spoke bluntly that if Article 370 will be tempered, no one in J&K will raise the Flag of India anymore.
